Through the use of the Cooper Health and Fitness Applications, LLC (hereinafter, “Cooper Apps”, “our”, “us” or “we”) web-based interfaces and mobile phone applications (the “Applications”), we may provide you content and interactive and informational resources and other services available through the Applications (the “Services”). Cooper Apps is committed to respecting the privacy rights of users of the Services and has created this Privacy Policy to explain its information collection and use practices and the practices and protection of your information it uses when you use the Services. Any term capitalized but not otherwise defined herein shall have the respective meanings set forth in the Cooper Health and Fitness Applications Terms of Use. This Privacy Policy is only applicable to the Applications and Services and does not apply to any websites, applications or services that are owned or operated by third parties (“Third-Party Services”), which may have data collection, storage and use practices and policies that differ materially from this Privacy Policy.


  1. Information Collection Practices
    1. Traffic Data
      Cooper Apps automatically gathers information of the sort that browsers and mobile devices automatically make available, including: (i) IP addresses; (ii) domain servers; and (iii) types of computers or devices accessing the Services (collectively “Traffic Data”). Traffic Data is anonymous information that does not personally identify you.
    2. Cookies
      A “Cookie” is a string of information that a website or application stores on a user’s computer or device. The purpose of Cookies is to identify the user as a unique user of the Services. Cooper Apps uses cookies to customize your experience on the Services, to ensure that you do not see the same informational messages repeatedly, and to store your username and password so you do not have to re-enter it each time you utilize the Services. If you do not wish to have Cookies placed on your device, you should modify the settings of your device before accessing the Application.
    3. Web Beacons
      “Web Beacons” (also known as clear gifs or pixel tags) are tiny graphics with a unique identifier, similar in function to Cookies, and are used to track the movements of users within the Applications. Unlike Cookies which are stored on a user’s device, Web Beacons are embedded invisibly on pages within the Applications (or in an email). Web Beacons may be used to count users who have visited certain pages and to understand usage patterns within the Application.
    4. Mobile Device Data
      When users download, install and use the Applications on their mobile phone or other wireless telecommunications device, Cooper Apps automatically gathers information, including without limitation, carrier providers, a unique device identifier, geo-location information (if allowed by the user), the types of mobile devices accessing the Applications, and the types of operating systems accessing the Applications (collectively, "Mobile Device Data"). A unique device identifier is a string of alphanumeric characters (similar to a serial number) used to uniquely identify and distinguish each mobile phone or other wireless communications device. Location services can be enabled or disabled at anytime, through the mobile device settings. Cooper Apps uses Mobile Device Data to understand usage patterns and to improve the Applications and Services.
    5. Personal Information
      You will be asked to provide Cooper Apps certain information related to you ("Personal Information"). Personal Information includes, without limitation: (1) "Contact Data" (personally identifiable information about you, such as your name and email address); and (2) "Demographic Data" (personal information about you (but doesn’t specifically identify you), such as your gender, birthday, zip code, country, height, weight, lifestyle and exercise frequency); and (3) "Fitness Data" (information about your use of the Services (but doesn’t specifically identify you), such as timing of certain fitness activities). The Personal Information you provide is used for such purposes as allowing you to set up a user account and profile, providing the Applications and related services, monitoring and improving the content and usage of the Services, and any other purpose for which the information was collected. We may also draw upon this Personal Information in order to adapt the Services to your needs, to research the effectiveness of our Services, and to develop new tools for our users. You are under no obligation to provide Personal Information, however, not providing this information may prevent you from using some or all features of the Services.
  2. Our Use of Your Personal Information and Other Information
    1. Personal Information
      We will use your Personal Information in a manner that is consistent with this Privacy Policy. If you provide Personal Information for a certain reason, we may use the Personal Information in connection with the reason for which it was provided. For instance, if you provide Personal Information for purposes of sharing it with one of our business partners (such as an insurance company), you authorize us to share your Personal Information with that business partner. Also, if you provide Personal Information in order to obtain access to the Services, we will use your Personal Information to provide access to such Services and monitor your use of such Services. We may also use your Personal Information and other personally non-identifiable information collected through the Services to help us improve the content and functionality of the Services, to better understand our users and to improve the Services.

      Cooper Apps uses your Contact Data to send you information about the Services, new product offers or functionality which are part of the Services and which you cannot opt-out of receiving. You may also receive periodic promotions and other offers or materials Cooper Apps believes might be of interest to you. You can opt-out of receiving these promotional messages at any time by (a) following the unsubscribe instructions contained in the email, newsletter, or promotion; or (b) changing the email preferences in your account.

      In an ongoing effort to better understand and serve the users of the Services, we may conduct research on our user’s Demographic Data and Fitness Data, interests and behavior based on the information provided to us. The research may be compiled and analyzed on an aggregate basis, and we may share this data with our affiliates, agents and business partners. Aggregated data will not identify you personally. We may also disclose aggregated user statistics in order to describe our Services to current and prospective business partners, and to other third parties for other lawful purposes.
    2. Traffic Data and Information Gathered Using Cookies, Web Beacons and Mobile Device Data
      Cooper Apps analyzes Traffic Data and information gathered using Cookies, Web Beacons and Mobile Device Data to help Cooper Apps better understand who is using the Services and how they are using the Services. By identifying patterns and trends in usage, Cooper Apps is able to better design the Services to improve your experience. From time to time, Cooper Apps may release Traffic Data and other information gathered using Cookies, Web Beacons and Mobile Device Data in the aggregate to its affiliates and business partners. Cooper Apps may share Traffic Data and Mobile Device Data and information gathered using Cookies and Web Beacons with: (1) third-party analytics companies so that such third-parties may help Cooper Apps better understand who is using the Services and how they are using the Services; and (2) service providers so that we can personalize, provide and improve our Services to your use and interests.
    3. Other Disclosure Practices
      Except as otherwise provided in this Privacy Policy, and when you otherwise give permission to us, Cooper Apps will not share your Personal Information with third-parties, except in the below circumstances.
      • Disclosure in Connection with Services. Cooper Apps discloses Personal Information to those who help it provide services, including those who perform technical, administrative and data processing tasks such as technical support, hosting, data storage and security.
      • By Law or to Protect Rights. Cooper Apps discloses Personal Information when required to do so by law, or in response to a subpoena or court order, or when Cooper Apps believes in its sole discretion that disclosure is reasonably necessary to protect the property or other rights of Cooper Apps, third-parties or the public at large.
      • Business Transfers; Bankruptcy. Cooper Apps reserves the right to transfer all Personal Information and other data in its possession to a successor organization in the event of a merger, acquisition, or bankruptcy or other sale of all or a portion of Cooper Apps’ assets. Other than to the extent ordered by a bankruptcy or other court, the use and disclosure of all transferred Personal Information will be subject to this Privacy Policy, or to a new privacy policy if you are given notice of that new privacy policy and an opportunity to affirmatively opt-out of it. Personal Information submitted or collected after a transfer, however, may be subject to a new privacy policy adopted by Cooper Apps’ successor organization.
  3. Security of Personal Information
    Cooper Apps has implemented and maintains reasonable security procedures and practices designed to protect against the unauthorized access, use, modification, destruction or disclosure of your Personal Information, however, despite these efforts, no security measures are perfect or impenetrable and no method of data transmission can be guaranteed against any interception or other type of misuse. In the event that your Personal Information is compromised as a result of a breach of security, Cooper Apps will promptly notify you if your Personal Information has been compromised as required by applicable law.
  4. Your Ability to Access, Update, and Correct Personal Information
    If you have registered for an account with the Services, you can access your Personal Information through the Application. If you completely delete all such information, you will not be able to use the Applications correctly. If you would like Cooper Apps to delete your Personal Information from its databases, please send your written request that we delete your Personal Information to: Cooper Health and Fitness Applications, LLC, Attn: Legal, 12200 Preston Road, Dallas, Texas 75230. Cooper Apps will use commercially reasonable efforts to honor your request; however, Cooper Apps may retain an archive copy of your records as required by law or for other legitimate business purposes. Cooper Apps wants your Personal Information to be complete and accurate. By using the Applications, you represent and warrant that all information you provide on any registration form or otherwise in connection with your use of the Applications and Services will be complete and accurate, and that you will update that information as necessary to maintain its completeness and accuracy.
  5. Third-Party Services
    The Applications and Services may contain links to, or with your permission, transmit your Personal Information to, Third-Party Services. Cooper Apps does not own or control these Third-Party Services. Cooper Apps is not responsible for the privacy and security practices and policies of those Third-Party Services and this Privacy Policy does not apply to any Third-Party Services. Before visiting, providing or authorizing the transmission of Personal Information to an owner or operator of Third-Party Services, you should inform yourself of the privacy policies and practices (if any) of the Third-Party Services, and should take those steps necessary, in your discretion, to protect your privacy. COOPER APPS DISCLAIMS, AND YOU AGREE TO ASSUME, ALL RESPONSIBILITY AND RISK FOR ANY DAMAGES OR OTHER HARM, WHETHER TO YOU OR THIRD PARTIES, RESULTING FROM YOUR USE OF THIRD-PARTY SERVICES.
  6. Children
    We do not knowingly collect Personal Information from children under the age of 13 and do not target our Services to children under 13. If you are under 13, please do not submit any Personal Information through the Services. We encourage parents and legal guardians to monitor their children’s internet usage to help enforce our Privacy Policy by instructing their children to never provide Personal Information through any of our Services without their permission. If you have reason to believe that a child under the age of 13 has provided Personal Information to us, please contact us, and we will endeavor to delete that information from our databases.
  7. Updates and Changes to Privacy Policy
    The Services we offer may change from time to time. As a result, it may be necessary for us to make changes to this Privacy Policy. Accordingly, we reserve the right to update or modify this Privacy Policy at any time and from time to time without prior notice. Please review this Privacy Policy periodically, and especially before you provide any Personal Information. This Privacy Policy was last updated on the date indicated above. Any material changes to this policy will be posted on the Applications (or you may be notified by email or other notification), and will indicate when such changes will become effective. You will be deemed to have agreed to any such modification or amendment by your decision to continue using the Applications or Services following the date in which the modified or amended Privacy Policy is effective. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used.
  8. California Do Not Track Disclosures
    Cooper Apps does not track its users over time across third party websites to provide targeted advertising, and therefore does not respond to Do Not Track (DNT) signals. However, some third party websites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. If you are visiting such websites, you can set the DNT signal on your browser so that third parties (particularly advertisers) know you do not want to be tracked.
